This letter is for use by South African call-back companies, who are members of SACBA, and should be addressed to their clients, together, with a letter for signature by the client, which may be found on the next page .


Letter to be cut 'n pasted onto your letterhead


On Tuesday, 12 August 1997, the South African Telecommunications Regulatory Authority ("SATRA") made a ruling in terms of which they declared call-back operations and all associated support activities to be "illegal". SATRA stated in their ruling that, from 1 September 1997, penalties will be imposed on any person who contravenes their ruling.

We, _________________ [name of call-back company] are a member of the South African Call-Back Association ("SACBA"), which represents all major participants in the South African Call-Back Industry. SACBA represents, actively supports and defends the rights of its members and, in the light of the SATRA ruling, legal advice on the position of both SACBA members and their clients was obtained during an urgent meeting with SACBA's attorneys.

SACBA and its attorneys are of the opinion that SATRA did not act in accordance and within the scope of the powers conferred onto them in terms of the Telecommunications Act of 1996 and that accordingly, all necessary steps will be (and the initial steps have already been) taken by SACBA's attorneys to contest the SATRA ruling and set it aside.

Neither we nor SACBA consider our business (call-back) operations to be illegal and we will continue to serve you, our clients, to the best of our abilities, as we always have.

SACBA will also lobby the appropriate forums and persons (both nationally and abroad) to exert pressure on SATRA to reverse its ruling and, to this effect, we would appreciate it if you would reproduce the draft letter attached herewith on your letterhead and forward same to us, duly signed, to show your support for SACBA and its members.
